1. Contest Period: Progressive Truck Tip Contest (the “Contest”) begins on October 15, 2008, at 12:00 AM (EST) and ends on March 31, 2009, at 11:59 PM (EST) (the “Contest Period”).
2. How to Enter: During the Contest Period, visit www.progressivetrucktips.com and follow the directions provided to complete registration and submit a Truck Tip. All entries must be submitted before March 31, 2009, at 11:59 PM (EST) to be considered. There is no limit on the number of entries per person, but each entry must be original and unique. By entering, individuals agree to comply with these Official Rules.
Each entry must be the contestant’s own original work, be in keeping with the Sponsor's image and may not be offensive, as determined by the Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights. Entries may not contain the name of the Sponsor’s competitors. Entries containing any forbidden matter or material otherwise deemed by Sponsor to be inappropriate will be disqualified.
3. Eligibility: The Contest is open to legal residents of the United States currently residing in the fifty states, and the District of Columbia who are age 18 years or older at the time of entry. The Contest, and any web site pages and advertisements relating thereto, are intended for viewing within the territory eligible for entry only. Employees, officers, directors, agents and representatives of the Sponsor, any of its respective parents, affiliates, subsidiaries, retailers, distributors, advertising and promotion agencies and suppliers, and any such individuals’ immediate family members (mother, father, sister, brother, child, husband, wife, and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related. Void where prohibited by law. The Contest is subject to all federal, state and local laws.
4. Judging: Entries will be judged by a panel of qualified Progressive commercial automobile employees (“Judges”). Judges will consider the following criteria in evaluating each entry: originality, relevancy to commercial vehicles and insurance, suitability as a radio advertisement, and popularity based on online voting at http://www.progressivetrucktips.com/.
Online voting will begin on October 15, 2008, at 12:00 AM (EST) and end on April 14, 2009, at 11:59 PM (EST). Winners may be disqualified, at Sponsor's sole discretion, for failing to follow the Official Rules.
5. Prizes: (1) Grand Prize winner will receive $5000.00, and their Truck Tip used in a radio advertisement. (6) Winners will each receive $500.00 for truck tips selected in the following categories: “Funny Tips,” “Fuel Savings Tips,” “On the Road Tips,” “On the Job Tips,” “Vehicle and Driving Tips,” and “Safety Tips.”
No substitution or transfer of prize is permitted, except by Sponsor, which reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. Any and all federal, state and local taxes on the prizes are the sole responsibility of the winners. Total Approximate Retail Value of all prizes: $8,000. Progressive reserves the right to modify or alter the winning tip as necessary to use in its advertisements.
6. Notification: Winners will be notified by telephone, mail and/or email. The winner will each be required to complete an Affidavit of Eligibility, Liability and Publicity Release, which must be returned within seven business days of date appearing on prize notification. Return of prize notification as undeliverable, failure to sign and return requested documentation within three (3) days of date of issuance or noncompliance with these Official Rules by any potential winner will result in disqualification and the prize may be awarded to a runner-up, at Sponsor's sole discretion. Winners will be announced online at http://www.progressivetrucktips.com/.
7. General Conditions: By participating, each entrant agrees: (a) to abide by these rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless Sponsor, and its respective parents, affiliates, subsidiaries and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, "Released Parties") from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant's participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize; and (c) to the use of his/her name, his/her Business Name if applicable, voice, article, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so, and (d) that Sponsor shall own the entry in any and all media now or hereafter devised for advertising, promotion, and other purposes, worldwide, in perpetuity, without compensation, permission or notification from the entrant or any third party of any kind, except as prohibited by law.
Sponsor reserves the right, in its sole discretion, to make changes to the Official Rules, or cancel, terminate, suspend, or amend this Contest for any reason including but not limited to a virus, bugs, non-authorized human intervention or other cause beyond the control of Sponsor, which corrupt or impair the administration, security, fairness, or proper play of the promotion. Sponsor reserves the right. ANY PERSON ATTEMPTING TO DEFRAUD OR IN ANY WAY TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST WILL BE INELIGIBLE FOR PRIZES AND MAY BE PROSECUTED TO THE FULL EXTENT OF THE LAW. SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON.
